I wound up sitting on the first row of the audience with the caveat that they had to introduce me as the father. Everything is going well so far. The state has rested. Defense goes tomorrow and the conclusion may happen tomorrow as well.

He got convicted of manslaughter (instead of murder) and assault 2nd (instead of assault 1st). It appears the maximum sentence would be 30 years. Sentencing will not be till next month.......at least it was better than the joke of a plea bargain they were offering.

I'm glad there was a conviction and that this guy will have to pay for what he did. Manslaughter instead of Murder and Assault 2 instead of Assault 1. As many of us know, the top charges don't always end up being what people get convicted of, but these are still serious charges. It probably could've turned out worse. Let's all hope that this guy gets the maximum penalty for these heinous crimes to your son and wife...and you . My guess is that he won't get the maximum but we can hope. If not, I hope it's at least 25 or so. If you are allowed to make an impact statement, I hope you're working on it already. Let the mutant know what he's done and the effect it has had on you and your family. As far as sitting in the first row.....if that was your decision, I back you up 100%. If it wasn't, well, I still back you up. As I hinted at in an earlier post, you weren't there to strike a blow for gay rights. You were there to obtain justice for your son and wife. Sometimes you have to do what you have to do to get the results that you're looking for. Sometimes it's just as brave to sit in the first row than sit at the table. I hope everyone agrees with me on this. If not, there's nothing I can do about it except still support you and your wife.
Is this trial being covered by the press? If so, I'd like to read the news reports about this case.

www.troymessenger.comThat is the local paper.....I think the final story was "Boswell convicted of manslaughter" Yes, Carroll, I will be able to be in the sentencing hearing and offer testimony. This will be the second time I've had to do this for a murdered/manslaughtered relative.

It's great to hear that some form of justice was served as a result of your tragedy. Congratulations, though I'm sure it only serves to assure you that the person responsible has been "proven beyond a reasonable doubt" of his reckless actions. How were you treated during the trial? You had expressed a concern that your private life might be brought out as if to discredit any part of the case. Hopefully you didn't have that hurdle as well. You can rest a little easier now with this behind you.

I was reminded that there were a lot of folks in that area that didn't like my lifestyle....or my "negatives" as it was put. But, the rationale for me setting behind my ex was ok....her dad was better known there and would be a better rep for the family.....so, I went along with it. In the end, it wasn't about my life....but about getting justice.
We still have the sentencing hearing next month...I get to talk at that one.

Scott, Your "negatives"! Hmmm. Bet they didn't mention any positives like a father who is still actively interested and involved in the process of bringing justice to the person responsible for his son's death, or that you are a public servant that puts his life on the line to protect the same people who are hurting him, a job few citizens want or would be able to handle. The "negatives". Like Dale says.....the main negative seems to be that you have to protect the rights and lives of those who probably prevent you from enjoying those same rights. You'll have your chance to address the court and that bum soon enough. I hope you get a few choice words in to those who would have you take a back seat. In addition to whatever you say to the creep who did this damage to you and your wife. RIP to little Clay.

After a very long morning and afternoon we found out the results. The hearing began at 10:00 am and was only suppose to last 30 mins to an hour...we were finished at 3:00 pm. Many family members had their chance to say their peace. It was very emotional.
The creep got 15 and a half years for manslaughter and also 7 and a half years for assault 2nd. We do not know yet if these will be consecutive or concurrent. There's the potential that he will have to serve 23 yrs if ran consecutive. Hopefully we will find out soon.

Same here, Scott. You've all been through something that no one should ever have to go through. I also tip my hat to you and yours. I hope you gave it to that guy but good. And I hope the sentences are consecutive. He should not get off lightly by any means. 15 years is nothing to sneeze at these days but it would be more appropriate for him to serve all of the time all of the way.
I hope things get better for you, your ex-wife and both of your families from here on in. And I hope you know all of you have support here.

UPDATE - The guy has been sent to prison. Apparently his request for a new trial did not go through. The judge never ruled on consecutive or concurrent sentencing. By law here, the sentence is consecutive if the judge does not state otherwise. So, he will likely file an appeal with the state court of criminal appeals and has likely done so already. I don't think he has a snowball's chance in a pizza oven of getting a reversal, tho.
